In short
- Use Yamsio with people you have really met, and treat them well.
- We have zero tolerance for content and behaviour that harm people. Report it and block it; we act on reports.
- What you send is yours. You let us store and deliver it so that Yamsio works.
- Your chats live on your phone. Keep your phone safe, and keep a backup.
These terms
These terms are an agreement between you and Volkstech about your use of Yamsio. By creating an account or using Yamsio, you accept them and our Privacy Policy. If you do not agree, do not use Yamsio.
Who can use Yamsio
- You must be at least 16 years old.
- One person per account. Use your own details, never someone else’s.
- You may not use Yamsio if we have closed an account of yours before, or if the law forbids you to.
- Your account is a Volkstech account, which also opens our other apps.
Your account and your trusted phone
- Keep your devices and the ways you sign in secure. You are responsible for what is done with your account.
- One phone is your trusted phone; it approves important changes. If you lose it, see Support.
- Tell us at once at support@volkstech.org if you think someone else has got into your account.
How Yamsio works
- You become kens by meeting and scanning a code. Show your code only to people you want to talk to: whoever scans it becomes your ken.
- Your chats live on your phone. The encrypted records we keep are not a backup you can restore: if you lose your phone without a backup, your chats may be lost. Keep one.
- Yamsio is free. If we ever offer something for a price, you will see the price before you pay; decorations you claimed while they were free stay yours.
What you must not do
We have zero tolerance for objectionable content and abusive users. You must not use Yamsio to:
- share, ask for or make sexual content involving anyone under 18, or groom, sexualise or exploit a child in any way — we report this to the authorities (see our child safety standards);
- threaten, harass, bully, stalk or intimidate anyone;
- promote violence, terrorism or violent extremism, or attack people for who they are, such as their race, religion, ethnicity, nationality, disability, sex, gender, sexual orientation or age;
- share intimate images of someone without their consent, or threaten to;
- encourage suicide, self-harm or eating disorders;
- sell or promote illegal goods or services, such as drugs or weapons;
- defraud, scam or phish anyone, or pretend to be a person or organisation you are not;
- send spam or bulk messages, or use bots or other automated means to use Yamsio;
- share someone’s private information without their consent;
- infringe copyright or other rights, including with music you put on your page;
- break the law, including Malaysia’s Communications and Multimedia Act 1998;
- get into accounts, devices or systems that are not yours, copy or take apart Yamsio’s software, disrupt or overload the service, or get around its limits or someone’s block.
If you record a call, follow the law where you and the other person are. Yamsio tells the other person that you are recording, but that alone may not be the consent the law requires.
Reporting and blocking
- You can report a person, a message, a group, a post, a comment, a diary, a guestbook entry or a page from inside the app. Your phone sends us what you report, and only our moderation staff can open it.
- You can block anyone. Someone you block can no longer message you, call you or see your Vuk.
- We aim to review every report within 24 hours, and reports about a child’s safety come first. We may remove content, warn someone, suspend or close accounts, and report to the authorities.
- You can also report by email to support@volkstech.org.
Your content
What you send and post stays yours. You are responsible for it, and you must have the right to share it.
You give Volkstech a worldwide, non-exclusive, royalty-free licence to store, copy, transmit and display your content only as needed to run Yamsio: to deliver it to the people you send it to, to keep the records our Privacy Policy describes, and to meet our legal obligations. The licence ends when your content leaves our records, except where the law requires us to keep it.
Yamsio’s own content
Yamsio, its design, its decorations, its tones and the music in its catalogue belong to Volkstech or to those who licensed them to us. You may use them inside Yamsio, for your own personal use. Do not copy, sell or extract them.
When we act
We may remove content, or restrict, suspend or close your account, if you break these terms, if the law requires it, or to protect people. When we can, we tell you why. If you think we got it wrong, write to support@volkstech.org and we will look at it again.
Leaving Yamsio
You can delete your account at any time, in the app or on our account deletion page. Some records are kept afterwards, as that page and the Privacy Policy explain.
Changes to Yamsio and to these terms
We may add, change or stop features. If we change these terms in a way that matters, we tell you in the app before the change applies. If you keep using Yamsio after that, you accept the new terms.
Our responsibility
We work to keep Yamsio available and secure, but we provide it as it is. It may sometimes be unavailable, and a message may be delayed or lost.
As far as the law allows, Volkstech is not liable for indirect or consequential loss, or for what other people send you, and our total liability to you is limited to RM100.
Nothing in these terms takes away rights that the law does not allow to be taken away, including your rights under the Consumer Protection Act 1999.
Apple and Google
If you got Yamsio from the App Store or Google Play, these terms are between you and Volkstech, not Apple or Google, and Volkstech alone is responsible for Yamsio.
- Apple has no obligation to provide maintenance or support for Yamsio.
- Apple is not responsible for any claim relating to Yamsio, including product liability, failure to meet a legal or regulatory requirement, consumer protection, or intellectual property claims.
- You confirm that you are not in a country subject to a United States Government embargo, and not on a United States Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Law
The laws of Malaysia govern these terms, and the courts of Malaysia may decide any dispute about them. This does not take away any right you have to bring a claim where you live.
